The General Terms and Conditions (GTC) of the SPC indoor swimming pool apply for the use of the facility, when renting water areas and when purchasing entrance tickets, subscriptions and prepaid cards. They also apply for collective users, such as schools, associations and other groups. The indoor swimming pool rules are an integral component of the GTC. When using the facility, renting water areas, purchasing entrance tickets, subscriptions and prepaid cards, users and renters accept these GTC and indoor swimming pool rules. The SPC reserves the right to change the GTC and the rules of the indoor swimming pool at any time as required. The GTC and the rules of the indoor swimming pool can be viewed at any time at www.paraplegie.ch/schwimmhalle.
Provisions for entrance rates
The current rates, entrance prices as well as reductions for the partner communities at Lake Sempach and discounts can be viewed on the website www.paraplegie.ch/schwimmhalle.
Single entrance tickets
Single entrance tickets are anonymous: no personal data is recorded. They entitle the holder to one entry on the respective day of the visit. They can be purchased at the SPC reception.
Single entrance tickets are valid for one year from the date of purchase and expire thereafter. After the holder leaves the facility, the single entrance ticket is no longer valid. Reimbursement is not possible and lost tickets will not be replaced.
Annual tickets and season tickets, prepaid cards
Annual tickets and season tickets as well as prepaid cards are personal and non-transferable. Each card has a deposit of CHF 10. The validity period is stored electronically. The season ticket is valid for 90 days. Prepaid cards do not have a fixed term and the credit remains valid indefinitely. Generally, it is not possible to have the credit paid out and a payout will only be made in exceptional cases (such as long-term medical certificate, moving away from the canton).
Truthful data disclosure
Users are obliged to give correct data, in particular the correct postal address. In the case of relocation, the rate will remain in place until the end of the term. Changes in address must be notified unrequested to the SPC reception at the latest when the subscription is extended. The SPC is authorised to make periodic address checks. If it can be proven that the wrong address has been given to obtain a lower rate unlawfully, the SPC reserves the right to take legal action.
Loss of card
If the card is lost, it can be blocked for a maximum of three months. The subscription or the credit cannot be used during this time. If the card is found, it can be unlocked free of charge upon submission of identification (presentation of an official identity document).
Users can receive a new card if the deposit on the old card has not been reimbursed. A deposit of CHF 10 will be charged again for the new card. The old card will no longer be valid. No liability is assumed for the remaining value on a lost card until its closure.
Extending subscriptions with a runtime
Generally, there is no entitlement to extend the validity of the subscription. Exceptions are possible as follows with proof (such as medical certificate, military call-up, flight certificate or similar):
sickness, accident or parenthood with a duration of at least 14 days will be fully credited. The same applies for recruit school or military service. In the case of holidays or stays abroad, the first 28 days will not be taken into account, thereafter, full credit will be made.
During official closures of less than one week, there is no extension of the subscription or reimbursement. If one or more areas are partially closed (for example, due to water area rentals or maintenance and construction work, etc.), there is no entitlement to a partial waiver or reimbursement of the entrance charge.
Opening times
The current opening times can be viewed on the website www.paraplegie.ch/schwimmhalle. There is no entitlement to reimbursement if the opening times are changed.
Consent form
The GTC are a part of the water area rent. The rented water area will be locked for public use during the rental time. Adjustments to the pool floor as well as construction and dismantling work are a part of the rental time. The current rental rates can be viewed on the website www.paraplegie.ch/schwimmhalle.
Cancellation costs/periods
Renters are responsible for checking the booking. Any discrepancies must be reported in writing at least ten days after receiving the confirmation.
Cancellations must be made in writing. Cancellation periods: cancellation is possible free of charge up to 21 days before the start of the rental; thereafter 100% of the rental costs are due.
Cancelling a rental appointment
The SPC can cancel a rental date with at least three weeks’ notice (for example, for events, championships or repair work that can be scheduled). The rent is not due. However, there is no entitlement to a replacement date.
If the GTC or the indoor pool rules are violated, the SPC can impose a temporary or permanent ban on entry. The duration of this ban is at the sole discretion of the SPC. Access is prohibited during the entry ban. The entrance fee will not be reimbursed, any rents already agreed will be cancelled, and subscriptions and prepaid cards locked.
Users enter the indoor swimming pool at their own risk. Staff instructions must be followed at all times.
To ensure the safety of the guests, some parts of the facility are monitored by video. The footage is used exclusively to prevent accidents, for the safety of the guests and to comply with the access regulations.
The data of users and renters of the facility will be processed in compliance with the Swiss Data Protection Act and according to the Privacy Policy at https://www.paraplegie.ch/en/legal-information/.
If the facility is closed due to force majeure, the GTC remain valid and the rent is due. There is no entitlement to a refund of entrances paid in advance or to an extension of the subscription.
If any provisions of these GTC are or should become ineffective, this does not affect the validity of the other provisions.
The SPC disclaims any liability in connection with the use and rent of the facility for damages and accidents that cannot be demonstrably attributed to obvious defects in the facility or to demonstrably grossly negligent or intentional behaviour of the SPC. Any liability that results from the non-observation of these GTC or these indoor swimming pool rules is also disclaimed.
The place of jurisdiction is Nottwil. Swiss law is exclusively applicable.
